1. Acceptance of These Terms

These Terms of Use ("Terms") form a binding legal contract between you and Dr. David Alcindor, an individual sole proprietor doing business as 4xForecaster ("4xForecaster," "we," "us," or "our"), operator of the website located at https://www.4xforecaster.com (the "Site") and the subscription services described below (collectively, the "Service"). By accessing the Site, creating an account, subscribing to a paid tier, viewing the public dashboard, or following our published feeds, you affirm that you (a) are at least eighteen (18) years of age, (b) have the legal capacity to enter into this agreement, (c) are not located in a jurisdiction where the Service is prohibited, and (d) accept these Terms in full. If you do not agree to these Terms, do not use the Service.

These Terms incorporate by reference our Privacy Policy, Disclaimer & Risk Disclosure, Subscriber Agreement (for paid tiers), Affiliate Disclosure, and Copyright & DMCA Policy.

2. The Service

4xForecaster publishes independent macro-driven directional-bias analysis for the U.S. dollar and major currencies. The Service is available in three tiers:

Free Tier — public dashboard, public articles including the Macro-to-FX Transmission Series, and public social-media commentary.

G-7 Membership ($37 to $67 per month, exact pricing disclosed at checkout) — subscriber-only G-7 currency analysis, premium dashboard views, and member commentary.

G-20 + Exotics Membership ($97 to $147 per month, exact pricing disclosed at checkout) — all G-7 content plus G-20 and exotic-currency analysis, expanded dashboard, and additional member commentary.

We may add, modify, retire, or rename tiers, and adjust pricing prospectively, at our discretion. Material price changes are disclosed in advance per Section 16.

3. Educational Publication; Not Investment Advice

4xForecaster is a publisher of independent financial commentary and analysis. 4xForecaster is NOT, and does not hold itself out as, a registered investment adviser, broker-dealer, futures commission merchant, retail foreign exchange dealer, introducing broker, commodity pool operator, commodity trading advisor, NFA member, or fiduciary of any kind. All content published through the Service is general in nature, impersonal, made available to all subscribers within a tier on a regular schedule, and is not personalized to any individual subscriber's investment objectives, financial situation, holdings, risk tolerance, tax position, or any other personal circumstance.

Nothing on the Service constitutes investment, trading, financial, legal, tax, or other professional advice, an offer or solicitation to buy or sell any security, currency pair, derivative, or other financial instrument, or a recommendation to enter into any transaction. You alone are responsible for your trading decisions. You should consult a licensed financial professional before acting on any information provided through the Service. 4. Eligibility, Account Registration, and Security

To subscribe to a paid tier you must register an account with a valid email address and accurate billing information. You agree to (a) provide accurate, current, and complete information; (b) maintain and promptly update your information; (c) safeguard your password; and (d) accept full responsibility for activity under your account. You will notify us promptly at security@4xforecaster.com of any unauthorized access. We may, in our sole discretion, refuse, suspend, or terminate any account.

Each paid subscription is licensed to a single natural person for personal, non-institutional use. You may not share login credentials, share access to subscriber-only content, or permit any third party to use your account.

5. License Granted to You

Subject to your continuous compliance with these Terms and timely payment of all applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Service and the content it makes available for your personal, non-commercial use only. This license terminates automatically upon any breach of these Terms.

6. Intellectual Property; Prohibited Uses

All content on the Service — including articles, the Macro-to-FX Transmission Series, dashboards, models, indicators, charts, code, designs, images, logos, video, audio, the analytical framework underlying the Service, and the selection, arrangement, and coordination thereof — is the exclusive property of Dr. David Alcindor or his licensors and is protected by United States and international copyright, trademark, trade-secret, and other intellectual-property laws. "4xForecaster" and the 4xForecaster logo are trademarks of Dr. David Alcindor.

You may not, and may not permit or assist any third party to:

(a) reproduce, republish, distribute, transmit, broadcast, publicly display, perform, sell, license, lease, frame, mirror, or create derivative works of the Service or its content, in whole or in part, except as expressly permitted under these Terms or by 17 U.S.C. § 107 (fair use, with full attribution);

(b) use any robot, spider, scraper, crawler, bot, browser plug-in, automated script, or other automated device or process to access, scrape, harvest, copy, index, or extract any portion of the Service, or to bypass any access control, rate limit, paywall, robots.txt directive, or technical protection measure;

(c) decompile, reverse engineer, disassemble, or attempt to derive the source code of the Service or any model, indicator, or signal underlying it;

(d) remove, obscure, or alter any copyright notice, trademark, watermark, attribution, or other proprietary marking;

(e) probe, scan, or test the vulnerability of the Service, breach any authentication or security measure, or interfere with the operation of the Service;

(f) impersonate any person, misrepresent your affiliation with any person, or use the Service to send unsolicited communications;

(g) use the Service or its content to develop, train, fine-tune, or evaluate any machine-learning model or artificial-intelligence system, or to populate any dataset for such use; or

(h) use the Service in violation of any applicable law, regulation, sanctions program, or third-party right.

Subscriber-only content is confidential and licensed to subscribers solely for individual, internal use. Any redistribution, posting in public or semi-public forums, sharing in trading rooms or messaging groups, copying into other publications, or use to construct any database is strictly prohibited and constitutes both a material breach of these Terms and copyright infringement.

7. Acceptable Use

You agree not to use the Service to (a) violate any law or third-party right; (b) post, transmit, or link to unlawful, harassing, defamatory, threatening, or obscene material; (c) interfere with the integrity or operation of the Service; (d) collect personal information about other users; (e) circumvent geographic or jurisdictional restrictions; or (f) engage in any activity that would cause us to lose any safe harbor or regulatory exemption.

8. Subscriptions, Billing, Automatic Renewal

The terms governing paid subscriptions, including pricing, billing cycles, automatic renewal, cancellation, and refunds, are set forth in the Subscriber Agreement, which is incorporated into these Terms by reference.

9. Termination

You may terminate your account at any time by clicking the "Click to Cancel" link in your account dashboard or by emailing cancel@4xforecaster.com. We may suspend or terminate your access at any time, with or without notice, for breach of these Terms, suspected fraud, non-payment, or any conduct that we determine in good faith creates risk or possible legal exposure. Upon termination: (a) all licenses granted to you immediately cease; (b) you must promptly delete any downloaded subscriber-only content; and (c) no refunds will be issued except as expressly provided in the Subscriber Agreement or as required by law.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, ANALYTICS, FORECASTS, DIRECTIONAL BIAS, DASHBOARDS, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.

WE DO NOT WARRANT THAT ANY ANALYSIS, FORECAST, OR DIRECTIONAL BIAS WILL PROVE ACCURATE OR PROFITABLE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF DATA SOURCED FROM THIRD-PARTY APIs INCLUDING THE FEDERAL RESERVE BANK OF ST. LOUIS (FRED) AND YAHOO FINANCE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) IN NO EVENT SHALL 4XFORECASTER, DR. DAVID ALCINDOR, OR ANY OF OUR LICENSORS, AFFILIATES, OFFICERS, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, OR OPPORTUNITY; OR ANY TRADING LOSSES, INVESTMENT LOSSES, OR LOSSES OF CAPITAL OF ANY KIND — ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF (i) THE TOTAL FEES PAID BY YOU TO 4XFORECASTER IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS (US $100).

(c) Nothing in this Section limits liability that cannot be limited under applicable law, including liability for fraud or willful injury.

12. Indemnification

You agree to defend, indemnify, and hold harmless 4xForecaster, Dr. David Alcindor, and our respective officers, employees, affiliates, agents, licensors, and service providers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any applicable law or third-party right; (c) any content you submit through the Service; (d) your use of the Service in any trading, investment, or financial decision and any losses arising therefrom; and (e) your gross negligence, willful misconduct, or fraud.

13. Governing Law

These Terms are governed by the substantive laws of the State of Delaware, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Dispute Resolution; Binding Individual Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND 4XFORECASTER TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION AND LIMITS THE WAY YOU CAN SEEK RELIEF.

(a) Informal resolution. Before commencing any formal proceeding, you and we agree to attempt to resolve any dispute informally for at least sixty (60) days by sending written notice to the other party.

(b) Binding individual arbitration. Any dispute not resolved under (a) shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act, 9 U.S.C. §§ 1 et seq., governs this Section.

(c) Procedure. A single arbitrator will hear the dispute. The seat of arbitration shall be the U.S. county in which you reside, but you may elect to appear by video, phone, or written submission.

(d) CLASS-ACTION WAIVER. YOU AND 4XFORECASTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable as to any specific claim, that claim shall be severed and proceed in court while the remaining claims continue in arbitration.

(e) Carve-outs. Either party may (i) bring an individual action in small-claims court if the dispute qualifies; (ii) seek injunctive or equitable relief in court for intellectual-property or confidentiality violations; and (iii) bring claims that cannot be required to be arbitrated under applicable law.

(f) 30-day opt-out. You may opt out of this Section 14 by emailing arb-optout@4xforecaster.com within thirty (30) days of first accepting these Terms.

(g) JURY-TRIAL WAIVER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PARTIES KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL OF ANY DISPUTE NOT SUBJECT TO ARBITRATION.

15. DMCA / Copyright Complaints

We respond to compliant notices under the Digital Millennium Copyright Act. See our Copyright & DMCA Policy for our designated agent and procedures.

16. Modification of These Terms

We may update these Terms from time to time. For material changes, we will provide at least thirty (30) days' advance notice by email and by conspicuous notice on the Site, and will require re-acceptance via clickwrap. Non-material changes take effect upon posting.

17. Force Majeure

We will not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including acts of God, war, terrorism, pandemic, governmental order, internet or telecommunications failure, hosting provider outage, third-party data-API failure, or regulatory action.

18. Geographic Restrictions and Sanctions

The Service is operated from the United States. You represent that you are not located in any country subject to comprehensive U.S. sanctions and are not on any U.S. restricted-party list.

19. Severability; No Waiver; Entire Agreement

If any provision is held invalid, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and us regarding the Service.
